GENERAL PROVISIONS
§ 151.01 NATIONAL ELECTRICAL CODE ADOPTED.
There is hereby adopted for the purpose of establishing rules and regulations
for the construction,
alteration, removal, and maintenance of electricalwiring and apparatus,
including permits and penalties,
that the certain electrical code known as the National Electrical Code
of the National Fire Protection
Association, 2005 dedtion, save and except for those portions as modified,
amended or deleted by this
chapter, of which 3 copies shall be on file in the office of the Building
Official, and the same are
hereby incorporated in this section as fully as if set out at lenght
herein and the provisions thereof
shall be controlling in the construction, alteration, maintenance and
removal of all electrical wiring
and apparatus within the corporate limits and, where applicable, the
extraterritorial jurisdiction of
the city.

§ 151.02 ADDITIONAL STANDARDS.
All electrical construction and all materials, appliances, motors, heating
devices, and apparatus used in connection with electrical work and the
operation of all electrical apparatus within the city shall conform
to the rules and requirements of the National Electrical Code current
when work is performed or equipment and apparatus installed; however,
necessity, good service, and results often require larger sizes of wire,
more branch circuits, and better types of equipment than the minimum
which is specified in the National Electrical Code. Therefore, the Building
Official will have the responsibility and authority for making interpretations
of the rules, for deciding upon the approval of equipment, materials,
and construction, and for granting the special permission contemplated
in a number of the rules; and the Building Official, where necessary,
shall follow the code procedure for securing official interpretations
of the code.

§ 151.04 ELECTRICAL INSPECTOR; QUALIFICATIONS;
COMPENSATION.
There is hereby created the office of electrical inspector. The electrical
inspector shall be versed in the approved methods of electrical construction
for safety of life and property and the National Electrical
Code.

§ 151.05 ELECTRICAL INSPECTOR; DUTIES.
(A) The electrical inspector, also referred to as the “city electrician,”
shall regulate and determine the
placing of electric wires or other appliances for electric lights, heat,
or power in the city and shall cause
all wires, appliances, or apparatus to be placed, constructed, and guarded
so as not to cause fires or
accidents, endangering life or property, and to be constructed so as
to keep to a minimum the loss or waste of electric current.
(B) Except as may be otherwise provided herein, it shall be the duty
of the electrical inspector to enforce all provisions of this chapter,
and he or she is hereby granted the authority to enter all buildings
in the city in the performance of his or her duties between the hours
of 8:00 a.m. and 5:00 p.m. daily; in emergencies and within the limits
of reason, the electrical inspector may enter buildings for these purposes
at other than the designated hours.
(C) It shall be the duty of the electrical inspector to inspect or
test all electrical work and equipment or apparatus for compliance with
this chapter. Whenever electric wiring, appliances, or apparatus shall
be
defective or hazardous through improper manufacture or improper or insufficient
insulation or any other
reason, he or she shall at once cause the removal of the defect or defects,
at the expense of the owners of that wiring, appliance, or apparatus.

ELECTRICAL WORK
§ 151.15 PERMITS REQUIRED; FEES.
1. Permits for electrical installations, repairs or alterationms shall
be required ad the fees for such permits shall be set out in the City
of McGregor Fee Schedule must be paid before the work commences. The
fees shall be doubled for any permit for which the work began before
the fees were paid.
2. Electrical permits shall only be issued to a master electrician
or master sign electrician; or
3. Except in new construction, a person applying for a permit for
electrical work to be performed on a homestead; when
(a). The person is listed as the property owner with a homestead exemption
on the tax roll of the county; and
(b). The work is to be performed by the owner of the property.
§ 151.16 INSPECTION.
Upon the completion of the wiring, installation, or alteration of any
building or structure for light, heat,
power, appliance, or apparatus, it shall be the duty of the person having
direct charge thereof to notify the electrical inspector, who shall,
as early as possible, inspect the wiring, installation, appliance, or
apparatus, and if it is installed, altered, and constructed in compliance
with the permit and in accordance with the requirements of this chapter,
he or she shall execute a certificate of satisfactory inspection, which
shall contain the date of the inspection and the result of the examination;
but no certificate shall be issued unless the electric wiring, motors,
heating devices, appliances, and apparatus are in strict
accord with the rules and requirements and the spirit of this chapter,
nor shall current be turned on the installation, equipment, appliance,
motors, heating device, and apparatus until this certificate is issued.
The amount of fee or charge to be made for the inspections and certificate
shall be fixed by the City Council.

§ 151.17 FAILURE TO COMPLY.
(A) Any person who shall fail to correct any defect or defects in his
or her work or to meet the required standards after having been given
notice of the unfit condition by the electrical inspector, within a
reasonable time, shall be refused any other permit until the defect
or defects have been corrected and
shall be subject to revocation of license for continual defective work
or either upon conviction for violation of any provision of this chapter.
(B) Upon failure to comply with this chapter, the electrical inspector
shall have the authority, after due notice, to interrupt or discontinue
electric current in the locality concerned.

ELECTRICIAN LICENSING
§ 151.30 ELECTRICIAN LICENSE REQUIRED
Electrical work within the city shall be performed by persons holding
current electrical licenses iddued by the State of Tecxas, and in conformance
with the requirements of (ELECTRICIANS) Title 8, Occupations Code, Chapter
1305 and the ( ELECTRICIANS) Administrative Rules of the Texas Department
of Licensing and Regulations, 16 Texas Administrative Code, Chapter
73 as attached to this ordinance unless specifically exempted from the
license requirements by this ordinance.
§ 151.32 INSURANCE
Contractors shall show proof of general liability insurance as required
by state laws or rules before a permit may be issued to the contractor.
§ 151.33 BOARD OF ELECTRICAL EXAMINERS.
For the purpose of this chapter, the following definition shall apply
unless the context clearly indicates
or requires a different meaning.
BOARD. The Board of Electrical Examiners of the city which shall be
appointed by the City Council
and shall consist of electrical inspector, one licensed and active master
electrician who should have at least ten years’ active service
as an electrician, and one person who either may be a registered professional
engineer or shall be actively engaged in the building or electrical
construction trade.

§ 151.37 PERMANENT ADDRESS.
Each holder of an electrical license of any class issued by the city
under the provisions of this chapter shall furnish the city electrical
inspector with his or her permanent post office address.

§ 151.99 PENALTY.
Any person who shall violate any of the provisions of this chapter or
who shall fail to comply with the requirements of this chapter shall
be deemed guilty of a misdemeanor; each and every day is contingent
to any violation or provision of this chapter shall constitute and be
deemed a separate offense. In the case of any violation of any of the
terms or provisions of this chapter by any corporation, the officers
and agents, and the person or persons actually performing the work for
the corporation shall be subject to the penalties as herein provided.
