§ 95.01 PARKS AND RECREATION BOARD; AUTHORITY.
The Parks and Recreation Board shall have the power to regulate the planting, preserving, spraying,
trimming, or removing of any tree, shrub, or plant on any street, alley, avenue, land, lane, public ground,
or square belonging to the city. If any tree or any part thereof is in an unsafe condition, or is injurious to
the common good, or to sewer pipes, pavement, or improvements, or is infested and dangerous to other trees, power is hereby given to the Parks and Recreation Board to secure the removal of those trees or parts thereof, or to secure the spraying of that tree, or to issue an order directing that tree or part thereof to be removed. If any tree or shrub on any private property is infested and in the opinion of the City Manager is infectious and liable to spread any disease, or if any tree or shrub is dangerous to the public, power is hereby given to the Parks and Recreation Board to direct employees of the city to enter that property and spray that tree or shrub, or remove same or any part thereof.

§ 95.02 CITY MANAGER; ACTIONS.
The City Manager may delegate any responsibility designated to his or her office under this chapter
to any employee or department within the city, and the action of the employee or department so designated shall constitute the action required of the office of the City Manager as provided for hereunder. All actions required of the City Manager shall be on behalf of the Parks and Recreation Board, and a report of all these actions shall made by the City Manager to the Board.

§ 95.03 UNLAWFUL ACTS.
It shall be unlawful for any person to plant, prune, remove, paint, or spray any tree, plant, or shrub on
any public highway or public place without first securing the permission from the office of the City
Manager. The permit shall state the kind and character of the trees, plants, or shrubs to be planted and the particular location on the public highway or public place where the same are to be planted.

§ 95.04 PLANTING IN PARKWAYS.
The City Manager shall supervise and direct the planting of trees, flowers, or shrubs in the parkways
between the sidewalk and the curb of the streets in the city. No person shall wilfully interfere with the
planting of trees, flowers, or shrubs in the parkway on any street within the city.

§ 95.05 DAMAGING TREES ON PUBLIC OR PRIVATE PROPERTY.
It shall be unlawful for any person to cut or break any branch of any tree, plant, or shrub or to injure
in any way the bark of any tree, plant, or shrub growing on any public highway, public grounds, or the
private property of another. No person shall allow any injurious substance to come in contact with any
tree, plant, or shrub growing on a public highway, public grounds, or private property.

§ 95.06 CONSTRUCTION WORK.
Whenever any person plans to do any sort of construction work around any public tree, plant, or shrub,
proper guards, to be approved by the office of the City Manager, shall be placed around that tree, plant
or shrub.

§ 95.07 PRUNING BY UTILITIES; PERMISSION REQUIRED.
Whenever any electric, telephone, or other public utility firm or corporation wishes to prune trees, for
the purpose of protecting its wires, that firm or corporation must first notify the office of the City Manager of its intention to do so and secure the permission of that office before the pruning is commenced.

§ 95.08 ELECTRIC WIRES; INSULATION OR REMOVAL.
Any person having any electrically charged wire, which is in contact with any tree, plant, or shrub and
which, in the opinion of the office of the City Manager, is injurious to that tree, plant, or shrub, shall
remove the wire or shall place proper insulation about that wire.

§ 95.09 ATTACHING OBJECTS TO TREES AND THE LIKE.

It shall be unlawful for any person to attach any cable, wire, rope, or sign, or any other thing, to any tree, plant, or shrub growing on any public property of the city, without first obtaining the permission of the office of the City Manager.
